What devices does it work with?
In-person it works really well with an iPad because we have an app designed specifically for iPad. A notification pops up on the iPad and you are good to go! It also works on any Phone, Tablet, or Computer!
Is it compliant with Federal E-Sign Act?
As per the Federal Electronic Signatures in Global and National Commerce Act (ESIGN) of 2000, a signature or record in electronic form cannot be denied legal effect, validity, or enforceability solely because it is in electronic form.
Our e-sign software provides a secure, reliable, and efficient way for dealerships to use electronic signatures in their transactions and complies with the requirements of the Federal E-Sign Act & the UETA including:
- Consent: Tap to Sign allows parties to give their consent to use electronic signatures and records in their transactions via the use of an E-Sign Consent page.
- Record retention & accessibility: Our software ensures that electronic records are retained in a secure and tamper-proof manner, allowing for accurate reproduction for later reference by all parties involved in a transaction. We employ industry-standard security measures to protect electronic signatures and records from unauthorized access.
- Authentication: Our software provides reliable and enforceable electronic signatures by capturing the customer's original signature through the use of an electronic signature pad. This ensures the authenticity and enforceability of the electronic signature, which can be compared against the customer's driver's license signature.
- Attribution: Electronic signatures are attributed to the person who signed them as logged on the Certificate of Completion, providing a clear record of who signed what and when. The certificate includes the date and time stamp of each signing event, which can be used to verify the authenticity of the signed document.
- Compliance with Truth-in-Lending: Moreover, per 12 CFR Part 1026 - Truth in Lending (Regulation Z), the Truth in Lending disclosures can be made electronically: "The creditor shall make the disclosures required by this subpart clearly and conspicuously in writing, in a form that the consumer may keep. The disclosures required by this subpart may be provided to the consumer in electronic form" [§ 1026.17 (a)(1)]
